The National Prosecuting Authority (NPA) has decided to prosecute EFF leader Julius Malema on a charge of crimen injuria. The case relates to statements he allegedly made about Eastern Cape school principal Jaco Pieterse.
The matter stems from the Cwecwe case, which attracted national attention earlier this year. Pieterse claims that Malema falsely linked him to the rape of a young schoolboy. He says the allegation harmed his reputation and dignity.
AfriForum’s Private Prosecution Unit confirmed that it assisted Pieterse with the case. The unit is headed by advocate Gerrie Nel. According to AfriForum, the NPA will proceed with criminal charges against Malema.
Other public figures may also face legal action
Pieterse previously opened cases against several public figures. They include ANC Secretary-General Fikile Mbalula and others who allegedly repeated the same claim.
AfriForum says Malema is the first person to face criminal prosecution in connection with the matter. However, the organisation says it may pursue further legal action against other individuals.
Case expected to draw national attention
The EFF had not released an official response at the time of publication. Meanwhile, legal experts expect the case to attract significant public interest because of the senior political figures involved.
Crimen injuria is a criminal offence in South African law. It involves unlawfully and intentionally violating another person’s dignity.
