
The African National Congress (ANC) has filed an application for leave to appeal a recent Eastern Cape High Court judgment that declared the appointment of the Provincial Task Team (PTT) unlawful and unconstitutional.
The court ruled that the ANC’s decision to replace the elected Provincial Executive Committee (PEC) with a PTT was invalid because it was not supported by a resolution of the ANC National Executive Committee (NEC). The court subsequently set aside the appointment of the PTT and barred its members from representing the ANC in the province.
In its appeal papers, the ANC and members of the disbanded PTT argue that the court made errors in granting both interim and final relief in the same application and that another court could reach a different conclusion.
A date for the appeal hearing has not yet been set. Until then, the High Court judgment remains in effect.
